What are the conditions to be met by the petitioner?
The petitioner must have the legal capacity failing which his legally appointed tutor or guardian may submit the petition. In case the petitioner is a representative of a juristic person (association, company, public institution or municipality), he must be qualified to act for this person before the courts (chairman of the Board, president of the association or the municipality or the person designated by the Statutes of the company, association or public institution or the Law on municipalities).
Moreover, the challenged decision must have prejudiced one of the petitioner’s rights in his appeal to the full jurisdiction judicial authority (such as his right to indemnity) or the petitioner must have a direct and lawful personal interest in contesting the validity of the challenged decision (such as the inhabitant of a locality challenging a decision granting a construction license or allowing the establishment of a classified institution; or the employee challenging a decision unduly promoting one of his colleagues to a higher rank).
