What kind of litigations falls within the jurisdiction of the State Council?
The Council has jurisdiction in litigations with public law persons (the State, public institutions-municipalities) and exceptionally with private law persons (concessionaries who operate a public utility or exercise public administrative authority). The Council may not examine litigations in connection with acts of the legislature, acts of government having a political character or affairs concerning the functioning of courts of justice.
The Council may not, also examine disputes with the State arising from acts performed as if it was an individual, in accordance with the principles of private law, i.e.(administration of its private properties, ordinary lease contracts in which the State is a party); car accidents and the administration of investment public institutions such as electricity, water and telephone administrations. |
