What is the remedy if the Administration abstains from enforcement?
This may happen despite the fact that the Council’s decisions are binding to the Administration. Enforcement against the State (and all public administrations) may not take place coercively through the recourse to the public force.
In order to remedy this situation, the Statutes of the Council allow, in its 1993 amendment, the imposition of a coercive fine on the State, or any other public law person, in case of unjustified abstention from enforcement. |
